Janssen Pays Dirty Money To Doctors for RisperdalThe Risperdal lawsuits are ongoing.
The Risperdal lawsuit is multifaceted, involving:
1. Claims of injury due Risperdal gynecomastia.
2. Claims that the advertising practices were illegal.
3. Claims that Janssen gave healthcare providers illegal incentives to prescribe their drug.
The Risperdal lawsuits have been going on for over a decade now, and are quite complicated. Federal and state governments have already settled with Johnson and Johnson’s pharmaceutical division, Janssen Pharmaceuticals.
Janssen has paid billions of dollars in settlements for illegally marketing Risperdal for uses that were not FDA approved.
In addition to advertising for non-FDA approved uses, or “off-label” uses, Janssen has been accused of offering illegal incentives for doctors and healthcare providers who prescribe Risperdal.
Janssen had State Officials in Their Pocket
After being investigated by the Office of the Inspector General, Janssen was accused of bribing doctors. It was also found that Janssen was depositing checks into an account controlled by Steve Fiorello, a State chief pharmacist of Pennsylvania.
Money from this account was also being sent to the Texas Department of Mental Health and Mental Retardation.
It turns out Johnson and Johnson was funding a program called TMAP- Texas Medication Algorithm Project- which was reportedly a front for an off-label advertising project.
TMAP was flying state officials all around the country offering cushy traveling accommodations while the officials promoted the drug for off-label uses.
The motivations of TMAP are questionable at best, as Risperdal and other atypical antipsychotics are nearly 10 times the price of first generation antipsychotics, and reportedly they are more likely to cause unwanted side effects as well.
Steve Fiorello was later brought up on charges for taking money from Janssen and other pharmaceutical companies.
In addition to marketing for off-label uses, the government has also accused Johnson and Johnson of giving kickbacks to medical professionals for prescribing Risperdal.
Janssen has been accused of calling the money a “speaker fee,” when really it was a bribe for doctors who prescribed more Risperdal.
In the District of Massachusetts a complaint was made that Janssen was paying millions of dollars in bribes to Omnicare Inc., a pharmacy specialized in providing medicine to nursing homes.
Risperdal is not approved for use in the elderly, and should have never been sold to nursing homes in the first place. When taken by older adults, Risperdal becomes very dangerous and increases the chances of dying from pneumonia or heart disease.
Janssen paid Omnicare millions for prescribing Risperdal, but claimed it was for educational funding, grants market share rebate payments, etc.
Janssen intentionally paid this company to sell Risperdal and hid it by making the money look like it was for something else.
Why A Risperdal Lawsuit is Necessary
The history of Janssen paying kickbacks and illegally marketing Risperdal is a long one, and we will probably never know the full story. As more news breaks regarding the Risperdal scandal, Janssen faces increasing fines and lawsuits.
Janssen Pharmaceutical Inc., of Johnson and Johnson have been fined billions of dollars, and for good cause. They decided to do what they wanted with Risperdal, and market it aggressively, throwing ethics and caution to the wind.
While Janssen profited, the cost was high to others, causing Risperdal side effects and sometimes death. Janssen and other pharmaceutical giants cannot be allowed to continue doing business like this; something has to change.
Whistleblowers like the former employees of Janssen are helping. Whistleblowers are people who decide to turn in incriminating information about companies such as Janssen, despite the fact that it will likely kill their own career in the industry.
Plaintiffs in the current Risperdal gynecomastia lawsuit are also helping. If it weren’t for those of us fighting back against this corporation, who knows what they would do to increase profits, and at what cost.
If you or your loved one has been affected by Risperdal gynecomastia, the time to act is now. Fill out the online claims form on this page or simply call the number below:
