Johnson and Johnson is currently still involved in litigation regarding one of their premiere drugs, Risperdal, and the medical links that have been made between this drug and gynecomastia or male breast growth. The litigation stems from this drug being marketed to children without FDA approval, which is very illegal and unethical, this drug was given to children while the side effects had not yet been tested for patients that young. In many of these cases, especially teenage boys, Risperdal gynecomastia was formed and is unable to be resolved with out costly corrective surgery or intensive testosterone treatment. Often times these surgeries are considered cosmetic and are not covered by many insurance companies and also may cost up to $3,500 out of pocket. As risperdal is one of the few antipsychotics that is covered by medicaid and though this surgery may seem like it is at the lower end of the cost spectrum, will likely remain out of reach for most of these patients. Especially considering these growths are an effect from a medicine that they were prescribed to help them, not ruin their lives.

The issue of Risperdal gynecomastia is very real and it is being found that many of these cases are having other than physical symptoms associated with this side effect. Teenage boys are having enough issues dealing with puberty, though they are growing up, they are still children and many of them may not have the capacity to handle all of this added stress. Not to mention the social ramifications of a teenage boy walking the halls of a high school with breasts, as it is common knowledge that bullying is very real in schools and has even been expanded with the premiere of social media less than 10 years ago. These are our children that are being tormented by the public and also by themselves. They are going through such a personal issue, yet they receive no understanding from their peers and often times their parents. It is not as though there are Risperdal gynecomastia support groups that are readily available as it is a fairly common, yet misunderstood ailment, so there they are left alone with nothing but their negative thoughts about themselves.

There is a light at the end of the tunnel for these patients suffering with Risperdal gynecomastia. As of September 2014, there were just over 600 plaintiffs involved in this litigation and the number is increasing by the day. The settlement at that point was looking to be about $2.2 billion dollars and if that was split evenly with this low amount of plaintiffs, that would be just over $3.6 million a piece. As this is settlement is still under negotiation and the plaintiffs are coming into the light more and more, this number will likely change, but one thing is for sure, Johnson and Johnson is not going to be getting off easy in the least as far as accountability is concerned.

Recent Risperdal Settlements

The makers of Risperdal have settled with the Department of Justice in 2013 for over 2.2 Billion Dollars. Currently they are settling with the States, and the Risperdal Settlement amounts are staggering. There is no doubt that people that were affected by the drug Risperdal will be next in line for a Risperdal Settlement. The Big question is what will the Risperdal Settlement amounts be.

Risperdal Belwether trials have yielded verdicts for the victims of 2.5 million, 1.75 million, and 500,000 thousand dollars. These trials help create a matrix for the Risperdal Settlement. What will happen next is that after intense negotiations between the attorneys on the Plaintiff Steering Committee,  and the attorneys for Johnson and Johnson, a Settlement will be reached.

Expect the Risperdal Settlement to have a graduated curve to it. For example an adolescent who developed gynoclamastia, and had breast reduction surgery will receive more then an adult who has gynoclamastia but did not have surgery.

We have heard from some members of the Plaintiff Steering Committee and the Risperdal Settlement amounts are much larger then they originally anticipated.

We have been told and mind you this is complete conjecture until the Risperdal Settlement is announced that people  specifically adolescents that had breast reduction surgery could see settlements between $800,000-1.2 million dollars.

The key here is that they had breast reduction surgery, many have had liposuction, and the younger you were when the surgery occurred the higher your award.

Possible Risperdal Settlement Amounts

We have also heard that people, specifically adults that suffered from gynoclamastia but have not had surgery would see between $100,000 to $200,000 dollars. Again keep in mind these numbers are pure conjecture at this point, but in speaking with different members of the Plaintiff Steering Committee there does seem to be a consensus.
