Settlements Reached Quickly in Early Risperdal Gynecomastia Lawsuits

The Risperdal lawsuit is in full swing, having already settled several claims. The first Risperdal lawsuit was filed on behalf of a young man who developed male breasts after taking Risperdal. It was settled on the first day of court, in September, 2012.

Five more Risperdal settlements were negotiated in state courts of Pennsylvania on October 3, 2012.

The plaintiffs alleged that Risperdal, an atypical antipsychotic medication caused them to develop male breasts, a condition known as gynecomastia.

They claim that Janssen, the pharmaceutical subsidiary of Johnson and Johnson failed to warn them about their risks of developing gynecomastia.

Plaintiffs in the Risperdal lawsuit also allege the drug was marketed for unapproved, or “off label” uses.

Janssen is being held responsible for their medical bills and pain and suffering, but the settlement amounts for the Risperdal lawsuits were not disclosed publicly.

There is speculation that the Janssen’s defense is settling before the testimony of Dr. David Kessler, a former FDA commissioner, is put on record.

Dr. Kessler has stated publicly that he believes Janssen broke the law by marketing Risperdal for unapproved, off label uses.

State Courts are Suing Johnson and Johnson for Improper Marketing

Johnson and Johnson has already been ordered to pay out hundreds of millions of dollars in Risperdal settlements to state courts.

For example Louisiana has ordered Johnson and Johnson to pay $258 million in penalties for making false claims about the safety of Risperdal.

When a manufacturer sells a drug they can only advertise it for FDA approved uses. In the case of Risperdal, claimants allege that the drug was improperly marketed for unapproved uses to both children and the elderly.

Risperdal has been found to increase mortality rates in the elderly, causing a higher risk of death due to conditions such as pneumonia and heart attack.

South Carolina courts have ordered a $327 million dollar penalty against the company for illegal marketing.

In addition to off label marketing, Johnson and Johnson is accused of giving doctors financial incentives to prescribe Risperdal.

Many other states have expressed interest in suing Johnson and Johnson for medicare reimbursement, on the basis that the company marketed it for off label uses.

What is Gynecomastia?

Gynecomastia is the development and enlargement of breast tissues in males.
